1. Acceptance of Terms
By accessing or using ImagePrompt ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
ImagePrompt is a digital marketplace providing curated AI image generation prompts. Users purchase credits to unlock individual prompts for personal and commercial use.
3. User Accounts
You must register for an account to purchase credits and unlock prompts. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to use the Service.
4. Credits and Payments
Credits are a digital currency used within the Service. Credits are non-refundable once purchased. Credits do not expire. Prices are shown in USD and are inclusive of applicable taxes. Payments are processed securely by Paddle.com.
5. License to Use Prompts
Upon unlocking a prompt, you are granted a non-exclusive, worldwide, royalty-free license to use the prompt text for generating images, including for commercial purposes. You may not resell, redistribute or sublicense the raw prompt text itself.
6. Prohibited Uses
You may not use the Service to generate illegal, harmful, defamatory, or infringing content. You may not attempt to reverse-engineer, scrape or extract prompts without purchasing them through the Service.
7. Intellectual Property
The ImagePrompt platform, branding, and curated prompt library are owned by Splash it S.r.l.. User-generated images created using our prompts belong to you.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. ImagePrompt shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing Law
These Terms are governed by Italian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
